1. Purpose and Applicability

This Refund and Returns Policy sets forth the terms and conditions under which Riffat Shaheen Studios (“we”, “our”, or “us”) addresses issues relating to damaged, defective, or otherwise unsatisfactory deliveries of physical artworks, including but not limited to sculptures and paintings (“Products”), sold through our official website.

This Policy applies to both domestic and international orders, unless explicitly stated otherwise.

2. Definitions

For the purposes of this Policy:

  • “Customer” refers to any individual or legal entity who has lawfully purchased a Product from Riffat Shaheen Studios.
  • “Delivery” refers to the transit of Product(s) from our premises to the address specified by the Customer.
  • “Courier” includes both third-party logistics providers and delivery services engaged directly by the Customer or Riffat Shaheen Studios.
  • “Customised Products” include any artworks that have been tailored, altered, or created based on specific instructions or requests made by the Customer.

3. Damage During Transit

3.1 If the Product arrives in a damaged condition, the Customer must notify Riffat Shaheen Studios within seven (07) calendar days from the date of receipt.

3.2 In such cases, the following documentation is required for claim validation:

  • Clear and legible photographs of the damaged Product from multiple angles
  • Copy of the purchase receipt or order confirmation number

3.3 Upon receipt and verification of the aforementioned documentation, Riffat Shaheen Studios shall, at its sole discretion, offer a one-time replacement of the damaged item, free of cost to the Customer, provided that:

  • The damage is verified to have occurred during transit, and
  • The delivery was arranged through Riffat Shaheen Studios or its authorised courier

3.4 Refunds shall not be issued under any circumstances; only replacements shall be offered for eligible damage claims.

4. Returns and Exchanges

4.1 If Riffat Shaheen Studios arranged the delivery:
We accept claims for replacement as per Clause 3 above. No return or exchange of undamaged artwork is allowed once delivered.

4.2 If the Customer arranged their own delivery service:
In such cases, all risks and liabilities are transferred to the Customer upon handover of the item to the courier. We shall not be liable for any damage, loss, or non-delivery occurring during transit under third-party arrangements.
No returns, refunds, or exchanges shall be entertained in such cases.

5. Non-Returnable Items

The following categories of Products shall be deemed final sale and are strictly non-returnable:

  • Customised or commissioned artworks
  • Products that show evidence of use, alteration, mishandling, or tampering
  • Items reported as damaged after the 7-day window has lapsed

6. Shipping Fees and Handling Costs

Unless expressly agreed in writing, the Customer shall not be entitled to reimbursement for shipping, handling, packaging, or customs fees incurred before or after delivery.

7. Liability and Limitations

7.1 Riffat Shaheen Studios shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of or in connection with the delivery, condition, or usability of the Product.

7.2 This Policy does not override any rights provided to consumers under applicable laws of Pakistan. In the event of any inconsistency, the provisions of this Policy shall be interpreted in favour of limiting the studio’s liability to the extent permitted by law.

8. Governing Law and Dispute Resolution

This Policy shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising under this Policy shall be subject to the exclusive jurisdiction of the courts of Islamabad, without prejudice to our right to institute proceedings in any other jurisdiction where relief may be sought.

9. Amendments

We reserve the right to revise or update this Policy at any time without prior notice. The updated version shall be effective immediately upon being published on our official website. Customers are advised to periodically review this page for any changes.
